6. Cancellation

 

Right of withdrawal for consumers

 

As a consumer, you can use your contract declaration within 14 days without giving reasons in written form (e.g. letter, fax, E-Mail) or - if the thing before the end of the period up to you revoked also by returning the goods. The time limit begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the recurring supply of similar goods not before receipt of the first partial delivery) and also not before fulfilment of our obligations in accordance with article 246 section 2 in conjunction with § 1, clause 1 and 2 EGBGB, as well as our obligations according to § 312 g paragraph 1 sentence 1 BGB in conjunction with article 246 article 3 EGBGB. The timely dispatch of the revocation or the goods is sufficient to safeguard the withdrawal period.

The customer is entrepreneur (§ 14 BGB), so he has no right of withdrawal and return pursuant § 312d BGB i. V. m. §§ 355, 356 BGB

 

Consequences of revocation

 

In the case of an effective revocation mutually received services are to be surrendered and any benefits (e.g. interest) are. You can received and (e.g. benefits of use) or not partially or only in worsened condition, return, or issue, you must as far as compensation for the value. Special notes

 

The right of withdrawal is not in distance contracts for the supply of

 

-Audio or video recordings or of software (especially for DVD's or software), provided that the delivered volumes are unsealed by the consumer,

 

-Goods which according to customer specifications are made are clearly tailored to personal needs or are suitable on the basis of their nature do not for a return or can spoil quickly or their Verfallsdatum would be exceeded.
